Terms of Use

These Terms of Use ("Terms") govern your use of Capture Culture services, including website access, mobile interactions, photo booth sessions, kiosk access, SMS messaging, digital photo delivery, and related software or service features. By using the service, you agree to these Terms.

2. Service Overview

Capture Culture provides automated photo booth experiences in which users may scan a QR code, select a session, provide contact information, receive a temporary access code, use that code at a kiosk, capture photos, and receive images through supported delivery methods.

3. Session Purchase and Use

  • Each session grants a limited number of captures or uses based on the selected session, tier, event, or offer
  • Sessions may be paid, sponsored, hosted, promotional, or free depending on the venue, operator, or event
  • All sales are final unless otherwise stated by Capture Culture or the applicable venue or operator
  • Session availability may vary based on venue conditions, event settings, hardware status, network connectivity, and system operation

4. Access Codes

  • Each eligible purchase or session may generate a unique access code
  • Codes are intended for limited use, are generally single-use, and typically expire within 24 hours unless otherwise stated
  • Codes are non-transferable and may not be reused once completed, expired, canceled, or otherwise invalidated
  • Lost, misdirected, or unused codes are not guaranteed replacement

5. Photo Capture and Delivery

  • Photos are captured and processed digitally through automated or semi-automated systems
  • Delivery may be provided by SMS, email, QR access, or other supported methods
  • Delivery timing may vary based on system status, message routing, carrier behavior, and connectivity
  • We do not guarantee successful or uninterrupted delivery in every case

6. Messaging Consent

By providing your mobile phone number and completing the presented consent step, you agree to receive transactional, service-related text messages from Capture Culture regarding your active session, such as access codes, session notices, or photo delivery links.

Consent to receive service-related texts is part of the Capture Culture session workflow where SMS delivery is enabled. Our text messages are intended for transactional or operational purposes connected to your session.

7. User Responsibility

  • You are responsible for entering an accurate phone number, email address, or other delivery information
  • We are not responsible for failed delivery caused by incorrect user input, carrier filtering, device issues, or lack of connectivity
  • You agree not to misuse the system, interfere with operations, attempt unauthorized access, or use the service for unlawful purposes

8. No Guarantee of Continuous Service Availability

Capture Culture services depend on internet connectivity, venue conditions, hardware performance, third-party service providers, and mobile carrier systems. Interruptions, delays, outages, or degraded performance may occur.

9. Data and Image Retention

Session data, contact data, and images are typically stored only temporarily to operate the session and support delivery. Most such data is generally deleted within approximately 24 hours. We do not guarantee long-term storage or retrieval of images.

10. Venue and Third-Party Responsibility

Capture Culture may operate within third-party venues or through independent operators, licensees, or partner environments. Those parties are responsible for their own local setup, devices, internet service, supervision, and operational conditions.

11. Intellectual Property

The Capture Culture name, branding, software, system design, layouts, workflows, and related visual or technical assets are owned by Capture Culture or used with permission and may not be copied, reproduced, distributed, or reused without authorization.

12. Limitation of Liability

To the fullest extent permitted by law, Capture Culture is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost photos, delayed delivery, message failure, venue conditions, or service interruptions arising from use of the service.

13. Indemnity

You agree to defend, indemnify, and hold harmless Capture Culture and its owners, operators, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising out of your misuse of the service, your violation of these Terms, or your violation of applicable law or the rights of another person.

14. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the service after any update constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
